Welcome to ReferaTrade (“we,” “us,” “our”). By accessing or using our website (the “Site”) or our platform and related services (collectively, the “Services”), you agree to comply with and be bound by the following terms and conditions (“Terms of Service,” “Terms”). If you do not agree to these Terms, please do not use our Services.

1. Our Services

ReferaTrade is a word-of-mouth referral platform that aims to connect consumers (“Consumers”) with trusted tradespeople, service providers, or other businesses (“Providers”) based on recommendations and verified details. We leverage user referrals, reviews, or other data to help Consumers make more informed decisions when hiring or engaging Providers.

While we strive to ensure reliable and up-to-date information, we do not directly employ or manage Providers; therefore, we do not guarantee the quality, safety, or timeliness of any services rendered by Providers. Any arrangement made between a Consumer and a Provider is strictly between those parties.

2. Registration & Accounts

To utilise certain features of our Services, you may be required to register for an account. You agree to provide accurate, complete, and up-to-date information during the registration process. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must promptly notify ReferaTrade of any unauthorised use or breach of security of your account. We reserve the right to suspend or terminate accounts that we believe, in our sole discretion, have violated these Terms or pose a risk to the integrity of our Services or the safety of our users.

3. Referrals & Reviews

ReferaTrade may provide functionality allowing users to submit referrals, reviews, ratings, or other user-generated content (“User Content”) regarding Providers. You acknowledge that any User Content reflects the views and opinions of the individual submitting such content and does not necessarily reflect our views or opinions. We do not endorse any User Content, nor do we guarantee its accuracy or reliability.

We reserve the right, but are not obligated, to monitor, edit, or remove User Content that we believe violates these Terms, our community guidelines, or applicable laws.

4. Payment & Subscription

Certain features of ReferaTrade may require a paid subscription or fee (collectively, “Subscription”). The details of your Subscription, including the applicable fees and renewal terms, will be provided at the time of sign-up. Unless stated otherwise, all fees are non-refundable.

4.1 Payment Method
We use third-party payment processors (e.g., Stripe) to handle subscription payments. By providing your payment information, you represent and warrant that you are authorised to use the designated payment method and authorise us to charge that payment method for the applicable fees on a recurring basis (unless you cancel prior to the renewal date).

4.2 Cancellation
You may cancel your Subscription at any time through your account settings or by contacting us. Your Subscription will remain active until the end of the current billing cycle, and you will not be charged for subsequent periods, unless otherwise stated.

4.3 Changes to Fees
We reserve the right to change our Subscription fees at any time. We will provide reasonable advance notice of any fee changes. Your continued use of the Subscription after the fee change becomes effective constitutes your agreement to pay the modified fee amount.

5. No Guarantee of Quality or Outcomes

ReferaTrade does not directly oversee or manage the services rendered by Providers. We make no warranties, guarantees, or representations regarding the qualifications, licensing, insurances, or suitability of Providers listed on our platform. Consumers are strongly encouraged to conduct their own due diligence before engaging in any agreement or transaction with a Provider. Any transactions, payments, or disputes are solely between the Consumer and the Provider.

6. Limitation of Liability

To the fullest extent permitted by law, ReferaTrade and its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to damages for lost profits, goodwill, use, data, or other intangible losses, arising out of or related to:

• Any acts, errors, or omissions by Providers or Consumers.
• The quality, timing, or outcome of any services performed by Providers.
• Disputes or issues arising between Providers and Consumers.
• User Content, including reviews and referrals that may be false or misleading.
• Any information posted on or accessed through the platform that may become outdated, inaccurate, or invalid over time.

You agree to release ReferaTrade from any and all claims, demands, or damages of every kind and nature, known and unknown, arising out of or in any way connected with any dispute between you and any Provider or Consumer.

7. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included therein. We do not guarantee that:

• Our Services will be uninterrupted or error-free.
• Any defects will be corrected promptly.
• The Services are free from viruses, malware, or other harmful components.

You expressly agree that your use of the Services is at your sole risk.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our Site. Your continued use of our Services following the posting of any changes constitutes acceptance of those changes. It is your responsibility to periodically review these Terms for updates.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
